On Wednesday, May 5th, 2021 the Canadian Council of Motor Transport Administrators (CCMTA) issued a message regarding the Electronic Logging Device (ELD) mandate coming into force on June 12, 2021.
Due to the many challenges caused by COVID-19, jurisdictions will adopt a progressive enforcement strategy with no penalties until June 12, 2022. Over the 12 months, the strategy will allow for timely adoption of ELDs, including the purchase, installation, and training required for compliance.
The main challenge the industry faces today regarding the ELD mandate includes obtaining and installing third-party certified ELDs. The lack of third-party certified ELDs remains a concern, and BCTA will continue to monitor the progress of certified ELDs entering the market. A list of approved devices can be found on the Transport Canada website as they become certified.
Commercial Vehicle Safety and Enforcement (CVSE) has published additional information in their recent National Safety Code Bulletin that specifically pertains to ELD regulations in BC which confirms that “all Canadian jurisdictions have agreed to pause enforcement until at least June 2022, focusing on education and awareness activities within the industry.” They note that if BC vehicles are being operated in other Canadian jurisdictions, it is important to verify the ELD requirements in each of these jurisdictions prior to travel. The CVSE bulletin also contains answers to commonly asked questions, including what the 12-month progressive enforcement period means for BC carriers and carriers from other jurisdictions that operate in BC. The BC Trucking Association (BCTA) continues to support the ELD mandate and anticipates working closely with the Ministry of Transportation and Infrastructure (MoTI) to shape the provincial progressive enforcement strategy. Given that the main purpose of the ELD mandate is to ultimately improve safety for all road users, BCTA will also continue to collaborate with MoTI in our undertaking to advance safety regulation for commercial motor vehicles (CMVs) with the proposed speed limiter mandate.
“With the announcement from CCMTA, we now look forward to cooperating with the Ministry of Transportation and Infrastructure as we develop and bring into force a provincial ELD regulation that includes a speed limiter mandate for commercial vehicles,” said Dave Earle, President and CEO of BCTA. “This will promote both safety of our roads and a reduction in our sector’s GHG emissions that will be achieved through more efficient speed management driving.”
The proposed mandate would occur in conjunction with the ELD mandate and implement speed limiter legislation at 105 km/h for CMVs with a gross vehicle weight of 11,974 kg or more in the province of BC.
The BCTA will continue to update members as updates to the ELD enforcement strategy and approved certified devices occur.
