The Government of Canada has announced that the final regulations on paid medical leave (10-paid sick days) have been registered and made available on Canada.ca. The regulations have been made available online in advance of their official publication in the Canada Gazette, Part II (scheduled for November 23, 2022). The regulations, along with the legislation, will come into force on December 1, 2022.
While both CTA has been actively engaged on this issue for over one year, the Government of Canada has now made its final decision on the implementation of paid medical leave. This is a permanent change to the Canada Labour Code and will apply to all private sector federally regulated companies, including trucking companies.
The final Regulations Amending Certain Regulations Made Under the Canada Labour Code (Medical Leave with Pay) outline essential elements of the new paid sick leave provisions, including how days are accumulated, how to deal with employees who are paid on a basis other than time, record keeping, and other key requirements. To assist in helping companies get ready, Employment and Social Development Canada (ESDC) held two information sessions last week (November 15 and 16).
On Tuesday November 29 (English) and Wednesday November 30, 2022 (French), ESDC will be hosting follow-up technical sessions to walk employers through key aspects of these new regulations. Note, the information presented in this session will be very similar to the information provided in the sessions on the 15th and 16th.
