A reminder that as of August 1, 2023, BC’s provincial ELD mandate comes into effect. Enforcement officers in BC may issue violation tickets to carriers who fail to equip a commercial motor vehicle with a certified electronic logging device (ELD) as required under MVAR 37.39.

The fine amount is $520 (or a ticketed amount of $598 when the victim surcharge is included). Fine amounts for violations under MVAR Division 37 are defined in the Violation Ticket Administration and Fines Regulation which is also being amended as of August 1, 2023.

As announced in NSC Bulletin 01-2023, BC does intend to implement a number of ELD exemptions. Drivers operating under those ELD exemptions are still subject to hours of service requirements and will continue to use a record of duty status to record their hours, but they will not be required to use an ELD to create the record of duty status.
